Privacy Policy

Auctify B.V. ("Auctify", "we", "us"), a Dutch company registered with the Chamber of Commerce under number 92337139 and established in Enschede, the Netherlands, operates the https://auctify.com website and the Auctify auction software. This page explains what personal data we collect, how we use it and what your rights are.

By using the Service, you agree to the collection and use of information in accordance with this policy.

1. Information Collection

We collect several different types of information to provide and improve our Service to you.

Personal Data

While using our Service, we may ask you to provide us with certain personally identifiable information ("Personal Data"), including but not limited to:

• Email address
• First name and last name
• Phone number
• Address, State, Province, ZIP/Postal code, City

Usage Data & Cookies

We automatically collect "Usage Data" regarding how the Service is accessed. This may include your IP address, browser type, time spent on pages, and unique device identifiers.

We use cookies and similar technologies. Some are necessary for the Service to work, such as the one that keeps you signed in and the one that remembers your language. The rest are for analytics and advertising, and those are only set after you accept them in the cookie banner. You can also instruct your browser to refuse all cookies, though some portions of our Service may become unavailable.

If you decline, no Google or Meta cookies are set and Meta is told nothing about your visit. Google Analytics still counts the page view, but without setting a cookie and without an identifier that would let us or Google recognise you again. You can change or withdraw your choice at any time through the Cookie settings link at the bottom of every page.

Separately, we set one first-party cookie that records how you first reached our site — the search, link or advertisement you came from — so we can see which channels bring us customers. It is never shared with anyone else, it contains no name, email address or account, and it expires after 90 days.

2. Use of Data

Auctify uses the collected data for various purposes:

• To provide, maintain, and notify you about changes to our Service.
• To provide customer support and gather analysis to improve the platform.
• To monitor usage and prevent technical issues.
• To process payments and comply with legal obligations.

3. Your Rights (GDPR)

If you are a resident of the European Economic Area (EEA), you have certain data protection rights. Auctify aims to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Data.

To exercise these rights, please contact us. We may ask you to verify your identity before responding to such requests.

You can also lodge a complaint with your data protection authority. Ours is the Dutch Autoriteit Persoonsgegevens.

4. Data Retention & Transfer

We keep personal data only as long as its purpose requires. A free-trial site that is not continued is paused on its seventh day and removed three days later. A paid site and its bidder data are removed when the subscription ends. Account and invoice records are kept for seven years, as Dutch tax law requires. Copies in server backups are overwritten in the normal backup rotation.

Our servers, including every customer auction site, are hosted with Google Cloud in the United States. Where data of people in the European Economic Area, the United Kingdom or Switzerland is transferred there, we rely on the EU-U.S. Data Privacy Framework, to which Google is certified, together with the European Commission's standard contractual clauses and, for UK data, the UK International Data Transfer Addendum.

5. Service Providers & Payments

We may employ third-party companies to facilitate our Service. These third parties have access to your Personal Data only to perform specific tasks on our behalf.

Payment Processing

We provide paid products and/or services. We use third-party services for payment processing. We do not store or collect your payment card details. That information is provided directly to our third-party payment processors:

Analytics and Advertising

With your consent we use Google Analytics, loaded through Google Tag Manager, to measure how this site is used, and the Meta pixel to measure the results of our advertising on Facebook and Instagram. If you start a free trial or pay an invoice after accepting cookies, we also report that event to Meta from our own server, with your email address in hashed form, so the result can be matched to the advertisement that produced it. If you decline, none of this happens. Both companies may process this data outside the European Union, under the EU-U.S. Data Privacy Framework:

Sub-processors

These are the companies that process personal data on our behalf. Each is bound by a data processing agreement with us.

• Google Cloud (Google LLC, United States): hosting of auctify.com and of every customer auction site, including databases and backups.
• Mailgun (Sinch Mailgun, United States): delivery of the emails our software sends, such as registration, outbid and winner notices.
• Stripe and PayPal: payment processing. On a customer auction site, payments go directly to that customer's own Stripe or PayPal account under that customer's agreement with them; Auctify never receives card or bank details.
• Google and Meta: analytics and advertising measurement on auctify.com only, and only with your consent, as described above. No analytics or advertising tags run on customer auction sites.

6. Security

The security of your data is important to us, but remember that no method of transmission over the Internet is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

7. Auction Listings on AuctionsNearMe

Auctify clients run their own auction sites and decide what their lots show. The client is responsible for that content, including having permission to publish any personal data in it, such as a home address or a person in a photo. Auctify hosts that content on the client's behalf.

To help lots get found, Auctify also lists each running lot on AuctionsNearMe.com, the auction discovery site run by the company behind Auctify, and is responsible for that listing. It shows the lot's title, description, photo, address and map location, start and end time, the auction site's name and a link to bid there. No information about bidders or buyers is included. We do this to deliver the service our clients signed up for, and on the basis of our legitimate interest in helping their auctions reach buyers.

Listings are public. They include structured data and are submitted to search engines, so search engines and other services may index or copy them; we cannot control copies kept by others.

A lot's page on AuctionsNearMe is withdrawn once the lot has ended. If a listing shows your home, your image or other information about you, you can ask us to remove it, whether or not you are an Auctify client (see Contact Us).

Bidders on Customer Sites: Who Is Responsible

Auctify plays two roles. For visitors to auctify.com and for our customers, we are the controller of your personal data, and this policy applies in full. For bidders and sellers on an auction site that one of our customers runs with our software, that customer is the controller: they decide what is collected and why, and we process the data only on their instructions, under our Data Processing Agreement.

If you bid on a customer's site, direct questions and requests about your data to the owner of that site first; their details are on the site itself. We help them answer. If a lot is published on AuctionsNearMe, the section above applies.
